General rental terms

Last updated: 28 October 2026

1. Purpose

These general terms govern the motorboat rental services offered by Cap Hendaia from the Port of Hendaye, France, whether for a daily rental or through the annual Boat Club subscription.

2. Requirements

Where required by law, the renter must hold a valid boating licence appropriate for the category of vessel rented. Proof of identity and a copy or proof of the licence may be requested before the boat is handed over.

3. Booking and payment

A booking becomes effective once confirmed by Cap Hendaia and once the deposit or total amount requested for the selected option (daily rental or Boat Club subscription) has been paid. Published prices are in euros (€).

4. Security deposit

A €3,000 security deposit is required before each trip. It is returned after the boat is handed back in good condition, less any repair costs for verified damage, where applicable.

5. Use of the boat

The renter agrees to follow the navigation limits communicated by Cap Hendaia, applicable maritime regulations, weather conditions and the maximum passenger capacity stated for each boat. Pets are not allowed on board. Fuel is the renter’s responsibility.

6. Cancellations and weather conditions

For daily rentals, cancellations must be communicated at least 48 hours before departure. Boat Club reservations can be cancelled at any time through the mobile app. We kindly ask members to cancel as early as possible so another member can book the boat. If weather conditions make navigation unsafe, Cap Hendaia may cancel or postpone the trip at no cost to the renter.

7. Boat Club (annual subscription)

The Boat Club subscription has an initial term of 12 months and provides access to boats at the selected base, according to the chosen option (single boat or Multi-Fleet). Each boat is shared by no more than five members, and bookings are managed through the mobile app using credits. Mooring, insurance and maintenance are included. Fuel is paid by the member.

8. Liability

The renter is responsible for the boat throughout the rental period and is liable for damage caused to the vessel, third parties or the environment through use that does not comply with these terms.

9. Governing law

These general rental terms are governed by French law. If a dispute cannot be resolved amicably, it will be referred to the competent courts in the location of Cap Hendaia’s place of business.
